Welcome to Dirtastic (“Dirtastic,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online shop, events, clinics, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Eligibility

You must be at least 18 years old to make purchases or register for events on your own behalf. Minors may participate in events only with the registration, consent, and supervision of a parent or legal guardian, who accepts these Terms on the minor's behalf.

Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us promptly of any unauthorized use.

Orders, Pricing, and Payment

Shipping, Returns, and Refunds

Shipping timelines are estimates and not guarantees. Returns, exchanges, and refunds are handled according to the policies provided at the time of purchase or otherwise communicated to you. Certain items may be final sale.

Events, Clinics, and Assumption of Risk

Dirtastic events and clinics involve riding and operating dirt bikes and other motorized vehicles, which are inherently dangerous activities. By registering for or participating in an event, you acknowledge and agree that:

• You voluntarily assume all risks associated with participation, including the risk of serious injury, property damage, or death.
• You are responsible for using appropriate safety gear and for ensuring you are physically fit to participate.
• You must follow all event rules, venue requirements, and instructions from Dirtastic staff and instructors.
• Event-specific registration terms, waivers, and release of liability forms may apply in addition to these Terms.

Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Interfere with or disrupt the Services, attempt to gain unauthorized access, or introduce malicious code.
• Infringe the intellectual property or other rights of Dirtastic or any third party.
• Harass, threaten, or harm other riders, staff, or community members.

Intellectual Property

The Services and all content, including logos, text, graphics, photos, and designs, are owned by Dirtastic or our licensors and are protected by intellectual property laws. You may not copy, reproduce, or distribute our content without our prior written permission.

Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, Dirtastic and its officers, employees, instructors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the Services or participation in any event. Where liability cannot be excluded, it is limited to the amount you paid to us for the relevant product or event.

Indemnification

You agree to indemnify and hold harmless Dirtastic from any claims, damages, losses, or expenses, including reasonable attorneys' fees, arising out of your use of the Services, your participation in an event, or your violation of these Terms.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
